Terms of Service

Worn Edit ("Worn Edit," "we," "our," or "us") provides wornedit.com and other websites under the wornedit.com domain, any corresponding mobile web experience, and any community spaces (collectively, the "Platform(s)"), and access to our clothing swap services (collectively with the Platforms, the "Services"), subject to your compliance with these Terms of Service (the "Terms"). By using the Platform(s) and the Services, you agree to be bound by these Terms, our Privacy Policy ("Privacy Policy"), and any additional policies incorporated by reference.

Worn Edit offers an online community where accepted users ("Members") swap clothing and accessories using credits ("Credits"). Members earn Credits by giving items to other Members and use Credits to request items from other Members.

To access the Services, you must create an account, complete your profile, and comply with our verification and safety requirements. Members who list items are "Listers" and Members who request items are "Requesters." When a swap is confirmed, the Lister and Requester enter into a direct agreement with each other for that swap.

As a Member, you are solely responsible for keeping your account information accurate and up to date. Worn Edit does not directly own, control, offer, or manage any items. Worn Edit is not a party to contracts entered into between Members, and is not a broker, insurer, or agent for any Member.

When using the Services, you agree to comply with all applicable laws, rules, and regulations.

IMPORTANT NOTICE REGARDING ARBITRATION FOR U.S. CUSTOMERS: WHEN YOU AGREE TO THESE TERMS YOU ARE AGREEING (WITH LIMITED EXCEPTIONS) TO RESOLVE DISPUTES WITH WORN EDIT THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT. PLEASE REVIEW SECTION 22 “DISPUTE RESOLUTION” BELOW.

1. Agreement to Terms

By using the Services, you agree to be bound by these Terms. If you don’t agree, do not use the Services.

2. Privacy Policy

Please review our Privacy Policy, which governs our collection and use of your information.

3. Changes to these Terms or the Services

We may update the Terms from time to time. If we do, we’ll post the updated Terms on the Platforms and/or send other communications. Continued use of the Services after changes constitutes acceptance. We may change or discontinue any part of the Services at any time.

4. Who May Use the Services

You may use the Services only if you are 18 years or older, have not been suspended or banned by us, and are capable of forming a binding contract. You must provide accurate, complete, and current account information and keep it up to date. You are responsible for all activity under your account. We may request identification or perform verification checks when permitted by law.

5. Access and Credits

Worn Edit is currently free for consumers to use. You do not pay a recurring membership fee to access swaps. Credits remain the unit of exchange on the Platform. We may introduce optional paid products or services in the future, and if we do, those terms will be presented to you at that time.

6. Credits

Credits are the unit of exchange for swaps. Each listing is assigned a credit amount, typically between 1 and 5, based on the item details such as category, brand, item type, and condition. Where offered in the product flow, Members may choose within the allowed credit band for that listing.

6.1 Starter credits

After you sign up, you unlock starter credits progressively as you publish listings: 1 credit at 1 listing, 3 total credits at 3 listings, and 5 total credits at 5 listings.

6.2 Earning and spending credits

You earn the listing’s credit amount when one of your items is successfully swapped. You spend the listed credit amount to request an item.

6.3 Credit reserve

When you submit a swap request, the listing’s credit amount is reserved from your balance. It is not spent until pickup is confirmed by both members.

6.4 Refunds and forfeiture

Credits are refunded when a request is rejected, expires after 72 hours with no response, or is canceled before pickup. If a requester no-shows, the reserved credit is forfeited. If a lister no-shows, the requester’s credit is refunded.

6.5 Non-transferable and no cash value

Credits are non-transferable, non-refundable, and have no cash value. Credits cannot be purchased, sold, or exchanged for money in the current release.

6.6 Credit limits

Credits do not expire in the current release. We apply a soft cap on balances to prevent hoarding. The current maximum is 50 credits, adjustable by the admin team if needed.

7. Using the Swap Service

7.1 Requests and approvals

Requesters submit swap requests through the Platform. Listers may accept, decline, or propose alternative pickup windows. Requests expire after 72 hours if not acted upon.

7.2 Pickup confirmation

Both members confirm pickup in the app. Confirmation triggers the credit transfer. In some cases we may require a pickup confirmation code.

7.3 Cancellations

Members should cancel as early as possible in the app. Cancellations before pickup refund the reserved credit. Repeated late cancellations may result in penalties.

8. Requester Responsibilities

Requesters are responsible for their own acts and those of anyone they authorize to pick up on their behalf. You must communicate promptly, follow agreed pickup details, and treat Listers with respect.

9. Lister Responsibilities

Listers must provide accurate listings, including size, condition, and any defects. Photos must represent the actual item. Listers must keep availability accurate and respond within 72 hours. Listers may decline any request at their discretion.

10. Prohibited Items and Content

You may not list counterfeit items, stolen items, or items that are damaged beyond reasonable wear. Hygiene-sensitive items are not allowed. You may not post content that is illegal, fraudulent, misleading, defamatory, obscene, or discriminatory.

11. Community and Off-Platform Activity

Members must coordinate swaps and communications through the Platform. Off-platform payments or swap arrangements are not allowed and may result in account action.

12. Disputes and Strikes

Disputes can be opened within 48 hours of pickup confirmation. We may issue credit refunds, warnings, strikes, or other remedies based on our review. Repeated no-shows or policy violations may result in account suspension or termination.

13. Your Content

You retain ownership of content you post. By posting content, you grant Worn Edit a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and marketing the Services. You represent that you have the rights to post your content.

14. Feedback

If you submit feedback, you grant us the right to use it without compensation.

15. DMCA/Copyright Policy

We respect copyright law. Repeated infringement may result in account termination.

The Services may link to third-party websites. We are not responsible for their content or policies.

17. Termination

We may suspend or terminate your access at any time. Upon termination, your right to use the Services ends immediately. Certain provisions of these Terms will survive termination.

18. Warranty Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

19. Indemnity

You agree to indemnify Worn Edit for claims arising out of your use of the Services, your User Content, or your violation of these Terms.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORN EDIT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO WORN EDIT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

21. Governing Law and Forum Choice

These Terms are governed by the laws of England and Wales, unless applicable law requires otherwise. If arbitration does not apply, disputes will be heard in the courts of England and Wales.

22. Dispute Resolution (U.S. Customers)

We encourage you to contact us first to resolve disputes informally. If a dispute cannot be resolved, it will be settled by binding, individual arbitration under the AAA Consumer Arbitration Rules. You and Worn Edit waive the right to a jury trial or class action. Either party may bring claims in small claims court or seek injunctive relief for intellectual property issues.

23. General Terms

These Terms are the entire agreement between you and Worn Edit regarding the Services. You may not assign these Terms without our consent. We may assign them freely. We may provide notices by email or by posting to the Services.
